Payment must be received and cleared prior to kitten/cat being shipped/taken to new home. All shipping, insurance and airline carrier charges shall be paid by the buyer. The Seller is not liable for kittens/cats lost or stolen after acceptance by the Buyer.

1. If this kitten/cat is sold as pet quality, it will be altered prior to pick up or shipping, no exceptions. The kitten's TICA registration blue slip will be provided to the Buyer if desired. If this kitten/cat is sold as a Show Alter, though we do produce Show Quality cats, we cannot guarantee performance in the ring, or how they will develop as they grow. Additionally, even beautiful cats sometimes do not care for being shown and do not do well. Therefore, we will inform buyers if the kitten/cat is a show prospect, but performance cannot be guaranteed.

3. If kitten/cat is purchased with breeding rights, under no circumstances shall this kitten/cat be sold/placed unaltered. Breeding rights are non-transferable. The first generation offspring of this kitten/cat shall not be sold unaltered under any circumstances. The kitten's TICA registration blue slip will be provided to the Buyer upon completion of contract.
4. The Seller provides a 48 hour limited warranty guarantee that the above kitten/cat is in good health at the time of purchase. It is the responsibility of the buyer to take the kitten/cat to a veterinarian within this time for a thorough examination. Failure to have the kitten/cat checked by a licensed veterinarian will void any guarantee. It is recommended that the new kitten/cat be quarantined for a period of one week before being introduced to other cats in your household. If found to be medically deficient with an untreatable or life-threatening problem, this must be reported to the Seller immediately. A signed statement from a licensed veterinarian as well as copies of any and all supporting diagnosis and/or documents are required to qualify for any exchange. If an untreatable or life-threatening problem is found, the Buyer has the choice to return the animal for a replacement. Upon its return, it will be replaced with a kitten/cat of equal value. If no replacement kitten/cat is available at the time of return, the Seller will have one year to furnish a comparable kitten/cat. Transportation and all veterinary costs are the responsibility of the Buyer. The Seller retains the right to have a second opinion of a Vet of their choice. If after reporting any adverse conditions, the Buyer may choose to keeps the kitten/cat thereby assuming all financial responsibilities. This health guarantee applies only to actual medical conditions that are life threatening and will not include any cosmetic conditions or conditions that are considered to be normal the Sphynx. After the 48 hour health guarantee period the seller cannot be held accountable for future diagnosis of FeLV/FIV/FIP, any bacterial or viral infectious disease, parasites or fungus; due to the fact that these can be contracted anywhere in the environment after leaving the cattery and are not a result of genetics or breeding. Buyer accepts all responsibility for protection of cat from said diseases, illnesses, parasites and fungi.
5. In the event of circumstances beyond the Seller's control where Seller cannot produce this kitten/cat at time of kitten/cat to go to his new home, Seller reserves the right to substitute another kitten/cat of equal or better value. If no kitten/cat is available at time, then Seller has up to one year to replace kitten/cat, however, Seller reserves the right to refund moneys paid for kitten/cat.
6. This kitten/cat is guaranteed against congenital defects for the first year of life. If the kitten/cat dies of a genetic condition, that was proven to be present prior to sale, before the age of one year then the kitten will be replaced with a kitten/cat of equal or greater value after a signed necropsy report from a board-certified veterinarian is received at the Seller's discretion. It is the Seller's right to ask for the kitten/cat to be returned for identification before providing a replacement. Under no circumstances is the kitten/cat to be destroyed prior to notification by the Buyer to the Seller. NO Cash Refunds will be given. If something goes wrong with your kitten/cat after the guarantee has expired, please contact us so that we are aware of the problem, can help you though the problem or help you to get a new kitten/cat.
7. Buyer agrees to keep kitten/cat quarantined for a period of 10 days from other cats or kittens. If kitten/cat has not been kept quarantined, warranty is void.
8. The Seller will have completed all of the age-appropriate vaccinations, worming, medical examining and altering by the time of purchase. If the Buyer chooses to vaccinate for the Feline infectious peritonitis (FIP, ringworm, feline leukemia virus (FeLV) or feline immunodeficiency virus (FIV), the warranty is null and VOID. Also, Seller does not warranty the kitten/cat against any adverse reactions to future vaccinations.
9. Buyer is solely responsible for any costs arising out of bodily injury or illness after said purchase and Seller is exempt from any charges. Buyer agrees to waive all claims against Seller for any injury or property damage arising out of or in any way related to purchase of above kitten/cat and to indemnify the Seller for any damages incurred by it. Buyer assumes all responsibility for the animal's actions after the effective date of this Contract as first set forth on page one. Buyer agrees to hold the Seller harmless from any and all liability associated with any illness of the kitten/cat, or damage or injury caused hereafter by above kitten/cat. The Seller shall not be responsible for any bodily injuries or property damage caused by the kitten/cat, or by the actions of the Buyer. The Buyer hereby specifically assumes sole responsibility for, and agrees to hold the Seller harmless from any and all loss and expenses.
10. Buyer accepts the responsibility of caring for the kitten/cat and will provide properly for its welfare. Buyer agrees to keep kitten/cat indoors at all times in a clean and pleasant environment, uncaged and with proper nutrition, health care (including yearly veterinarian examinations and vaccinations), companionship, and adequate space for exercise. Buyer agrees to provide weekly baths and ear cleanings along with daily eye cleaning (as required). These cats' bodies produce oil, which dirt clings to. Failure to bathe and provide weekly ear cleanings may result in skin issues and even deadly ear infections. The above kitten/cat will leave this Cattery freshly bathed with trimmed nails and freshly cleaned ears.
11. It is understood that degrees of hairlessness in Sphynx vary from cat to cat and that no Sphynx is completely hairless. It is understood that hormones, climate, and genetics play an important role in hairlessness and that even though a Sphynx kitten may be almost hairless when sold, it is possible that above kitten/cat could develop some hair after being neutered/spayed or as it grows older. It is also impossible to guarantee that any Sphynx kitten/cat will not grow some hair at some point in the future.
12. Buyer understands that if the kitten/cat is found to be neglected or mistreated in any way Seller shall have the unconditional right to reclaim the above kitten/cat WITHOUT refund of the purchase price. Neglect shall include, but is not limited to: being left alone without human companionship for periods in excess of 72 hours, lack of proper sanitary facilities, being caged, providing poor diet and poor health. Mistreatment shall include, but is not limited to: lack of proper food, lack of proper medical care, lack of fresh water, and any form of physical abuse. Buyer will be responsible for any veterinary bills directly incurred as a result of any neglect or mistreatment.
13. Buyer agrees this cat will not be declawed. To declaw a cat, the first digit of the toe is removed and is extremely painful. In humans, it has been compared to the removable of the finger to the first joint. Declawing may cause improper potty behavior (refusal to use litter box) due to possible permanent nerve damage in the paws. This is due to the cat associating using the litter box with pain from the hard litter so it looks for alternate, softer places to potty. Declawing may also alter a cat's personality, temperament, health and ability to walk. It may result in improper social behavior since by removing a cat's first line of defense; it may resort to biting to protect itself when threatened. It also leaves them defenseless against dogs should the unforeseeable happen and the cat escapes the house. Declawing puts Buyer in default of contract.
14. Shipping available at the buyers expense, no refunds on shipping cost after transfer of animal, no exceptions.
15. Unforeseeable circumstances such as but not limited to divorce, relocation, and/or death of the caretaker can occur, leaving a pet homeless. Buyer agrees that under NO circumstances will the kitten/cat EVER be sold, leased, or given to any pet shop, animal shelter, research laboratory, or similar facility. Should Buyer not be able to keep the above kitten/cat for any reason, including the incapacitation or death of the Buyer, the Seller has the FIRST option to take said kitten/cat back at no charge including shipping to be rehomed or kept by Groovy Sphynx no questions asked. Buyer will at no time resell, lease, give away or otherwise transfer ownership without written permission from the Seller. This remains in effect for the ENTIRE life of the kitten/cat.
16. Seller has the conditional right to reclaim kitten/cat without refund of purchase price for any breach of contract. Breach of contract penalty fee is purchase price of above kitten/cat.
17. Any legal action which may arise under the terms of this contract will be brought in Jefferson County, Ohio, USA. Buyer shall be liable for any court costs and related charges including attorney's fees associated with Seller enforcing the terms of this contract. In signing this document, Buyer acknowledges that he/she has read, fully understands, and agrees to ALL of the terms and conditions stated above. The laws of the State of Ohio shall be controlling.
